CaseNotify Terms & Conditions

Standard Terms for Indian Legal Practice & Litigation Tracking

These Terms & Conditions govern your access to the CaseNotify platform, WhatsApp notification APIs, and automated cause-list tracking services.

Section 1

Definitions

For the purpose of these Terms & Conditions:

Accountmeans a registered user account created on CaseNotify.
Advocatemeans an advocate, legal practitioner, law office, law firm, or authorized legal professional using the Services.
Clientmeans an individual or organization represented by the Advocate.
Public Court Informationmeans information made publicly available by official court systems including eCourts.
Servicesmeans all software, APIs, web applications, websites, WhatsApp notifications, emails, and related offerings provided by CaseNotify.
Section 2

Eligibility

To use CaseNotify, you represent and warrant that you:

Are at least eighteen (18) years of age
Have the full legal capacity to enter into binding contracts
Are legally authorized to access and use the Services
Strictly comply with all applicable Indian laws and professional regulations

CaseNotify is intended primarily for advocates, law firms, legal practitioners, and authorized legal professionals.

Section 3

Account Registration & Security

When registering for an Account on CaseNotify, you expressly agree to:

  • Provide accurate, current, and complete registration details
  • Keep your profile and contact information updated promptly
  • Maintain absolute confidentiality of your login credentials
  • Immediately notify us of any unauthorized access or security breach
You remain fully and solely responsible for all activity conducted under your account credentials.
Section 4

Nature of Services

CaseNotify provides specialized legal technology services to assist advocates by:

Automatically discovering publicly available court cases
Tracking hearing dates across multiple courts
Synchronizing case status and cause list information
Sending automated hearing reminders to advocates
Delivering instant WhatsApp notifications
Sending scheduled email digests and alerts

CaseNotify expressly DOES NOT:

  • Provide legal advice or opinions
  • Represent advocates in any capacity
  • Replace court clerks or human verification
  • Guarantee hearing dates against sudden adjournments
  • Guarantee absolute official court information accuracy
Section 5

Automated Case Discovery

CaseNotify automatically retrieves publicly available court information using search parameters such as:

By using the Services, you expressly authorize CaseNotify to periodically perform such automated searches on your behalf.

⚠️ Case discovery does not guarantee that every discovered case belongs to you. Advocates must review and verify all discovered cases before relying upon reminders.
Section 6

Advocate Responsibilities

By using the platform, you specifically agree and covenant that:

You are authorized to use the Services and represent clients before courts.
You will independently verify hearing dates using official court records.
You will diligently review automatically discovered cases.
You will promptly report or remove incorrect case associations.
You will not intentionally misuse or disrupt the Services.
Section 7

Client Information & Representation

Where you provide client contact details or information into CaseNotify, you represent and warrant that:

You are fully authorized to provide such client information.
You have obtained all necessary client consent under Indian law.
The submitted contact information is accurate and up to date.

CaseNotify is not a party to and is not responsible for any disputes arising between an Advocate and their Client.

Section 8

WhatsApp Notifications

CaseNotify leverages the official WhatsApp Business Cloud API to send automated alerts regarding:

Client Enabling: Advocates are strictly responsible for enabling notifications only for clients who have consented and are authorized to receive them.

Right to Suspend: CaseNotify reserves the right to suspend or terminate messaging services if spamming, misuse, or abuse is detected.

Section 9

Acceptable Use Policy

By using CaseNotify, you explicitly agree NOT to engage in any of the following prohibited activities:

Violate any applicable local, state, or national law
Impersonate another advocate or law office
Access accounts without explicit authorization
Interfere with platform security mechanisms
Reverse engineer or decompile the Services
Scrape or systematically extract CaseNotify data
Distribute viruses, malware, or harmful code
Abuse, flood, or circumvent our APIs
Attempt denial-of-service (DoS/DDoS) attacks
Section 10

Intellectual Property Rights

All software, source code, logos, trademarks, branding, user interfaces, documentation, and original content created by CaseNotify remain the exclusive intellectual property of CaseNotify.

These Terms & Conditions do not transfer ownership of any intellectual property rights from CaseNotify to you or any third party.
Section 11

Public Court Information & Authority

CaseNotify retrieves publicly available court information solely to provide hearing tracking and reminder services.

CaseNotify does not own court information
CaseNotify does not modify official records
CaseNotify does not certify court records

Official court records and portals (e.g. eCourts.gov.in) remain the sole authoritative source for all judicial information.

Section 12

Subscription Plans

Certain advanced Services on CaseNotify require a paid subscription. Subscription tiers and plans may vary depending upon:

Number of Active Cases
Number of Team Users
WhatsApp Notification Limits
Premium Analytics Features

Pricing and subscription allocations may change from time to time with reasonable advance notice provided via email or dashboard notice.

Section 13

Payments & Billing

Where applicable for paid subscription plans:

Subscriptions are billed securely in advance
Applicable statutory taxes (such as GST) are additional where required
Payments are processed through authorized payment gateways (e.g., Razorpay)
Failure to make timely subscription payment upon renewal may result in temporary restriction or suspension of active notification services.
Section 14

Cancellation Policy

Users hold the right to manage or cancel their paid subscriptions at any time from their account billing dashboard.

Future Renewal Prevention:Cancellation immediately stops all automatic future billing cycles and renewals.
Refund Terms:Cancellation prevents future renewal but does not automatically entitle the user to a pro-rata refund for the ongoing billing period unless explicitly approved under our Refund Policy.
Section 15

Suspension & Termination of Service

CaseNotify reserves the right to suspend, restrict, or terminate user accounts that:

⚠️ Attempt unauthorized access to data
⚠️ Abuse WhatsApp or email messaging facilities
⚠️ Interfere with general platform operations
Section 16

Service Availability & Uptime

We strive to provide continuous, uninterrupted Services to support your daily legal practice. However, availability may occasionally be affected by:

⏱️ Regional Internet Failures
⏱️ Cloud Provider Outages
⏱️ Government/ISP Restrictions
⏱️ Upstream eCourts Portal Availability

Continuous 100% uninterrupted availability is not guaranteed due to dependencies on external court information systems.

Section 17

Third-Party Services & Dependencies

CaseNotify relies upon specialized, enterprise-grade third-party service providers including:

Clerk (Auth)MongoDB Atlas (Database)Vercel (Cloud Infrastructure)Meta WhatsApp Cloud API (Messaging)ZeptoMail (Email)Payment Gateways

CaseNotify is not liable or responsible for temporary service degradations or failures directly caused by downstream outages of these third-party infrastructure providers.

Section 18

Limitation of Liability

To the fullest extent permitted by applicable Indian law, CaseNotify, its founders, directors, and employees shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

Sudden hearing date changes or adjournments
Inaccurate or delayed public court information
Incorrect case associations or name collisions
Synchronization delays from court servers
Missed reminders or delayed WhatsApp/Email alerts
Court portal downtime or eCourts server errors
Internet outages or network disconnection
Advocate negligence or failure to verify cause lists
Client non-availability or dispute with advocate
Indirect financial losses or business interruption
Loss of profits or anticipated revenue
Reputational damage or professional liability claims
⚖️ The total aggregate liability of CaseNotify for any claim arising out of or relating to the Services shall not exceed the total subscription amount actually paid by the user to CaseNotify during the preceding three (3) months.
Section 19

Indemnification

You agree to defend, indemnify, and hold harmless CaseNotify, its founders, employees, contractors, and affiliates against any and all claims, liabilities, damages, judgments, and expenses (including reasonable legal fees) arising from:

Your intentional misuse or abuse of the Services
Submission of unauthorized or non-consensual client information
Your violation of any applicable Indian laws or bar council regulations
Your infringement of third-party intellectual property or privacy rights
Inaccurate or false information submitted by you during registration or case setup
Section 20

Platform Disclaimer & Independence

CaseNotify is an independent software platform built for legal workflow management.

We explicitly declare that CaseNotify is NOT affiliated with, endorsed by, or operated by:

National Informatics Centre (NIC)
eCourts Services
Supreme Court of India
Any High Court in India
Any District / Sub-ordinate Court
Government of India / State Governments

Official court records remain the only authoritative source. Users must independently verify all cause lists and hearing information before court appearances.

Section 21

Privacy & Data Processing

Your access to and use of the Services is also strictly governed by the CaseNotify Privacy Policy.

By using the Services, you consent to the collection, processing, storage, and communication of information as detailed in our Privacy Policy.

Section 22

Force Majeure

CaseNotify shall not be liable or deemed in breach for any delays or failures in performance directly or indirectly caused by events beyond our reasonable control, including but not limited to:

Natural Disasters & Floods
War or Civil Unrest
Riots & Strikes
Major Regional Internet Outages
Global Cloud Infrastructure Failures
Sophisticated Cyber Attacks / DDOS
Government / Statutory Restrictions
Public Health Emergencies
National eCourts Portal Interruptions
Section 23

Changes to Services & Terms

As our technology stack evolves, CaseNotify reserves the right to periodically:

Reasonable commercial efforts will be made to notify active users via email or in-app notice prior to material pricing or core feature changes.

Section 24

Governing Law

Jurisdiction & Applicable Law

These Terms & Conditions and all access to or use of the Services shall be governed by, construed, and enforced in accordance with the laws of the Republic of India, without regard to conflict of law principles.

Section 25

Dispute Resolution & Jurisdiction

Amicable Resolution First: Before initiating any formal legal proceedings, users agree to first contact CaseNotify support at support@casenotify.com to attempt an amicable and good-faith resolution within thirty (30) days.

If unresolved amicably, any disputes, controversies, or claims arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts situated at Pune, Maharashtra, India (or the applicable registered city of CaseNotify operations), unless otherwise required by non-waivable statutory law.
Section 26

Severability

If any provision or clause of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed or modified to the minimum extent necessary.

The remaining provisions of these Terms shall continue in full force and effect without being impaired or invalidated.

Section 27

Entire Agreement

Complete Understanding

These Terms & Conditions, together with the Privacy Policy, applicable subscription billing terms, and any explicit addenda, constitute the complete and exclusive entire agreement between the user and CaseNotify regarding the subject matter hereof, superseding all prior oral or written representations or agreements.

Binding Agreement

By creating an account, accessing, or using the CaseNotify Services, you expressly acknowledge that you have read, understood, and agree to be legally bound by these 29 Terms & Conditions.
